Indian River County files another lawsuit against Virgin Trains

Indian River, Fl- Indian River county has filed yet another lawsuit against Virgin Trains, aka Brightline, aka All Aboard Florida.

The county is arguing that they should not be required to pay to upgrade the 21 railroad crossings, which needs to happen for the high speed train to pass through the county. Indian River County is arguing that their agreement to maintain the crossings is with Florida East Coast Railway, not with Virgin Trains USA. They argue that since the improvements would only benefit Virgin Trains, they shouldn’t be required to pay for them.

Martin County settled their lawsuits with Virgin Trains last year. As part of the agreement the company agreed to pay for some of the maintenance costs of the railroad crossings for 14 years, as well as additional improvements.
