Get-away driver will not be charged with Felony murder

Martin County, Fl- The Martin County State Attorney’s Office has decided not to charge 16-year-old John Clark with murder 17-year-old Jakeem McMillian died.

McMillian died from a gunshot wound to the head during a robbery in Martin County in December.

This happened on December 13th, at the Treasure Coast Liquidators off of US1.  A 17-year-old boy went in asking to see gold rings and a gold chain. Barbara Dacey, the owner of the store, said he tried on three rings. She told the teen he couldn’t try them all on at once. Then, according to a document from the Martin County Sheriff’s office, the teen threatened her life. Dacey’s husband, Michael, said the teen ran out of the store with the rings. He then got into a Jeep, driven by a 16-year-old. Michael Dacey shot at the car as it drove away, hitting the 17-year-old in the head.

On Friday, David Lustgarten and Kaitlin Bingham from the Martin County State Attorney’s Office stated Clark will not be charged with murder. They explained if they charged Clark with murder, they would have to prove beyond a reasonable doubt that Clark knew McMillian was going to commit robbery instead of theft, which they explained is difficult to do.
